सर्वांचेच आरक्षण रद्द करा- सराटेंची याचिका

अ] SC,ST, OBC, VJNT, SBC, मराठे या सर्वांचेच आरक्षण रद्द करा, त्याऎवजी आर्थिक निकषांवर सवलती द्या, मंडल आयोगाचा अहवाल १९८०, जो मा.केंद्र सरकार व मा.सर्वोच्च न्यायालयाने स्विकारलाय तो रद्द करावा असे श्री सराटे उच्च न्यायालयाला सांगताहेत. सर्वोच्च न्यायालयाच्या ७ न्यायाधिशांच्या घटनापिठाने दिलेला आदेश उच्च न्यायालय बदलू शकते काय? मध्यप्रदेश, राजस्थान, छत्तीसगडमधल्या शेतकर्‍यांच्या आक्रोशात ज्यांची सरकारे वाहून गेली, तेच शेतकर्‍यांच्या प्रश्नांचे गांभिर्य कमी करण्यासाठी व शेतकरी ऎक्य मोडीत काढण्यासाठी श्री. बाळासाहेब सराटेंच्या काठीने जातीयुद्ध भडकावित आहेत काय? सध्याचे राज्य व केंद्रीय मागास वर्ग आयोग मा. सराटेंना मान्य नाहीत. त्यांना तिसरीच शक्ती हवीय.

ब] मराठ्यांचीही नॉन क्रिमी लेयरची वार्षिक मर्यादा रू. ८ लाखाहून वार्षिक रू. ६० हजारपर्यंत इतकी कमी करणे आवश्यक आहे अशी त्यांची मागणी आहे.

क] मा.सराटे मराठ्यांचेही आरक्षण का रद्द करायला सांगताहेत?

ड ] SC,ST, OBC, VJNT, SBC, या सर्वांचेच आरक्षण काढून घ्यायला ते का सांगताहेत?

इ] मा.सराटेंचा बोलवता धनी कोण आहे?

सध्याची आरक्षण पद्धत म्हणजे लोकशाहीची हत्त्या असल्याचा मा.सराटेंचा दावा आहे.

मा. सराटेंच्या मागण्या पुढीलप्रमाणे आहेत -

१. राज्य शासनाचा १८ मे १९५९ चा आर्थिक दृष्ट्या मागासलेपणावर आधारित आरक्षण देण्याचा आदेश पुन्हा लागू करावा,

२. पुढील सर्व कायदे, शासन आदेश रद्द करावेत,
अ] शासन आदेश ९ एप्रिल १९६५, च्या आदेशाने सरकारी नोकरीत आरक्षण देण्यात आले.
ब] शासन आदेश १३ ऑक्टोबर १९६७, १८० ओबीसी जातींना व विजाभज यांना १४% आरक्षण देण्यात आले.
क] शासन आदेश १३ एप्रिल १९६८,
ड] शासन आदेश २३ मार्च १९९४,
ई] महाराष्ट्र राज्य आरक्षण अधिनियम २००४, सरकारी नोकरीतले आरक्षण रद्द करावे,
फ] महाराष्ट्र राज्य आरक्षण अधिनियम २००६, उच्च शिक्षणातले आरक्षण रद्द करावे,

वरील सामाजिक न्यायाचे सर्व शासनादेश व कायदे लोकशाहीची हत्त्या करणारे आहेत असे श्री.सराटे याचिकेत म्हणतात.
ते म्हणतात, नॉन क्रिमी लेयरची वार्षिक मर्यादा रू. ८ लाखाहून वार्षिक रू. ६० हजारपर्यंत इतकी कमी करावी.

They can finally look forward to education, health care and economic empowerment

Left untouched by the Centre’s welfare juggernaut, the denotified, nomadic and semi-nomadic tribes (DNTs) that comprise about 10 per cent of the country’s population can finally look forward to education, health care and economic empowerment among other benefits.

The Union Ministry of Social Justice and Empowerment is all set to seek the Cabinet’s approval for implementation of the recommendations that were made by the Balkrishna Renke Commission in 2008 and by the National Advisory Commission (NAC) in 2011.

The Renke Report, which has 76 recommendations, included designating the DNTs as a “scheduled group”, with a special quota of 10 per cent. Though it was circulated for inter-ministerial consultations, the issue remained relegated to the backburner.

A fresh set of recommendations by the NAC and a recent reminder has given the issue an impetus and the Ministry is hopeful of bridging the gaps in the implementation of welfare measures for the DNTs.

The Ministry has, however, sidestepped the issue of extending 10 per cent reservation on the grounds that it will violate the existing 50 per cent ceiling [for reservation] as mandated by the law and require a constitutional amendment.

According to a senior ministry official, there is a proposal to establish a separate National Commission for the denotified tribes for an initial period of two years, a separate division in the Ministry, constitution of corporations at the national level with an initial equity of Rs.200 crore and access to free education and scholarships.

“The National Commission for DNTs will be mandated to prepare a State-wise list of castes that belong to denotified and nomadic tribes, identify the castes, which have not been included in the list of SC/ST/OBCs, identify the DNT populated areas,” said the official.

The Ministry is also looking at utilising ‘Aadhar’ for identifying and reaching out to the DNTs. Once the nomadic communities are identified they will be able to benefit from the welfare schemes wherever they are.

These recommendations, that come ahead of the State Assembly elections in Karnataka, Delhi, Tripura, Rajasthan, Nagaland, Mizoram, Meghalaya and Madhya Pradesh, are also an attempt by the Centre to woo the denotified tribes that have been deemed as one of the most neglected people in the country.

The Renke Commission had earlier pointed out that those DNTs who have been classified as SC/ST/OBCs have not been able to benefit from the reservation policy. As per the Renke Commission, roughly 10 per cent of the country’s population is denotified with 150 tribes, 500 nomadic communities.

In its 2008 report, the Commission had suggested recommendations across 14 broad categories, which incorporated special schemes for pastoral communities, reservation in government jobs and representation in Human Rights and Women’s Commission, BPL, ration and voter identity cards, housing and habitation and employment.

NEW DELHI: The Centre has decided to roll out programmes of economic and educational empowerment for denotified and nomadic tribes — the most vulnerable of social groups — but ruled out special reservation regime for these communities on the lines of backwards and dalits.


The nomadic and denotified tribes would be identified across states so that initiatives can be launched for their welfare, recognizing the existence of these groups on national scale.

They would be eligible for educational and economic benefits at par with OBCs like scholarships, skill development, coaching and loans among others.

A "national commission", like the National Commissions for SCs and STs, would be created for their identification as also for suggesting measures required for their uplift. A "national development corporation" would also be constituted for funding their entrepreneurial initiatives.

The ministry, headed by Kumari Selja, would soon seek the Cabinet nod for new welfare regime targeting these tribes. "It is a much-required initiative for the holistic development of these weak groups," the minister said.

With these tribes forming a chunk of population in Gujarat, Maharashtra and Madhya Pradesh, the Congress would hope to attract their votes in 2014 elections.

Constituting 11% of the national population, these tribes form a significant voting bloc but have been swamped by stronger dalits and backwards with whom they compete for affirmative action. Around 85% of them have either been clubbed among OBCs or SCs/STs.

While moving to address the development needs of nomadic/denotified tribes through welfare schemes, the social justice ministry has decided against Renke panel's recommendation for special reservation.

The panel, mandated to identify measures to address the socio-economic needs of these tribes, suggested that they be culled out of SC/ST/OBC lists and be put together in a "scheduled group" with special quota of 10%.

The Union ministry has opposed the creation of new category for two reasons — not only will a "scheduled group" like SC/ST require a constitutional amendment but a special quota would breach the 50% ceiling on quota that would invite legal hassles.

Instead, the ministry has recommended that a national commission for denotified tribes would be launched with the mandate to identify them across states and in SC/ST/OBC lists, and to recommend measures for their welfare. It would also pursue the case of tribes who have not yet been put in SC/ST or OBC lists.

The national commission would also make the maiden assessment of the progress made by these tribes and suggest measures to be launched for their development.
